Standardized Field Sobriety Testing for DUI in Arizona is Under Challenge

Tags:

Standardized Field Sobriety which is popular for DUI arrests is flawed. Standardized Field Sobriety testing has been a bone of contention with DUI attorneys in Arizona for years. The problems with standardized tests are that there are no standards to judge them by. These so called standardized tests are nothing but pseudoscience. Unlike traditional field sobriety testing that was used twenty years ago, these tests give no actual indicator of how impaired a driver is.

The officers are asked to put together indicators about the person’s demeanor and how well they follow instructions. Most people are not in any state of mind when stopped by a police officer, to test well on anything. The current tests are designed for failure. Few sober people can pass the first two because they involve listening carefully to instructions that sometimes are just silly. It is human nature to only hear about one word out of three that another person speaks.
